Scope
This End User License Agreement (“EULA”) is between you and Airmeez Inc. (“Airmeez”, “we”) and governs your use of software that Airmeez makes available to you (the “Software”).
Airmeez products are deployed by customer organizations under service agreements. If your organization has a signed agreement with Airmeez, that agreement governs its deployment and controls over this EULA wherever the two differ. This EULA applies to your individual use of the Software, and stands alone only where no signed agreement covers that use.
Use of this website is governed separately by the Terms of Service.
License grant
Airmeez grants you a limited, non-exclusive, non-transferable, revocable license to use the Software for your organization’s internal business purposes, in the form Airmeez provides it and within the scope of the deployment it was provided for. The Software is licensed, not sold.
Restrictions
Except as a signed agreement or applicable law expressly permits, you may not:
- copy, modify, or create derivative works of the Software, or remove its notices and attributions;
- sell, rent, sublicense, or otherwise make the Software available to anyone outside the deployment it was provided for;
- reverse engineer, decompile, or disassemble the Software, except to the extent a law that overrides this restriction allows it;
- bypass or test the limits of the Software’s security or access controls without written authorization from Airmeez;
- use the Software in violation of applicable law.
Ownership
The Software and everything in it belong to Airmeez and its licensors, who keep all rights this EULA does not expressly grant you. Feedback you choose to give about the Software may be used by Airmeez without obligation to you.
Your data
Data handled by a deployment of the Software belongs to the customer organization that deploys it, and Airmeez processes it on that organization’s behalf under the agreement governing the deployment — as described in the Privacy Policy. Nothing in this EULA transfers ownership of your data to Airmeez.
Third-party services
The Software may operate alongside, or connect to, systems and services that Airmeez does not provide — your organization’s communication systems and services from third parties. Those are governed by their own terms, and Airmeez is not responsible for them.
Updates
Airmeez may provide updates to the Software, and updates are covered by this EULA unless they come with their own terms. How and when updates are applied to a given deployment is set by the agreement governing that deployment.
Disclaimer
Where no signed agreement provides otherwise, the Software is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
Limitation of liability
To the fullest extent permitted by law, and subject to any signed agreement that provides otherwise, Airmeez is not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of — or inability to use — the Software, and Airmeez’s total liability to you under this EULA is limited to the amount paid for the Software use giving rise to the claim, or one hundred U.S. dollars (US$100) if nothing was paid. Nothing in this EULA excludes liability that cannot be excluded under applicable law.
Termination
This license ends when the deployment it was granted for ends, when a signed agreement governing it says it ends, or when Airmeez terminates it because you have broken this EULA. When it ends, stop using the Software. Sections on ownership, disclaimers, and limitation of liability survive termination.
Changes to this agreement
When this EULA changes, the revised version is published on this page with a new effective date. Changes do not modify a signed agreement, and your continued use of the Software after the effective date is acceptance of the revised EULA.
